1. Nature of the service
City Farm (the "Service", the "App", the "Platform") is an online directory and discovery tool for independent organic, natural and artisanal food stores, farms and producers in the Netherlands. The Platform exists to help users find alternatives to industrially processed and ultra-processed products and to connect them with local producers.
City Farm does not sell, produce, package, transport, deliver or warrant any product listed on the Platform. We do not act as agent, intermediary, broker, distributor or reseller of any store. All commercial transactions take place exclusively and directly between the user and the store.
2. Information published on the Platform
Information about each store — including but not limited to name, address, opening hours, telephone, website, photographs, product descriptions, prices, origin claims, certifications, promotions, stories, delivery options and any other content — is provided either by the store owner or compiled from publicly available sources.
The store owner is solely and exclusively responsible for the accuracy, completeness, legality, certification, labelling, food safety and quality of the products and information related to their store. City Farm performs only a basic, non-binding curation and provides no warranty whatsoever regarding such information.
Organic, biological, biodynamic, Demeter, EKO, "fresh", "natural", "artisanal", "small farm", "local" or similar designations shown on the Platform reflect what the store communicates to its public. City Farm does not perform on-site audits and does not act as a certification body.
2bis. Food safety, hygiene and origin (Dutch law)
Every store, farm and producer listed on the Platform must comply, at their own expense and risk, with all applicable Dutch and European food-safety, hygiene, labelling and traceability legislation, including but not limited to the Dutch Commodities Act (Warenwet) and the Warenwetbesluit Hygiëne van levensmiddelen, EU Regulation 852/2004 (general hygiene of foodstuffs, HACCP), EU Regulation 178/2002 (General Food Law and traceability), EU Regulation 1169/2011 (food information to consumers), the applicable sector Hygiene Code (Hygiënecode), and — for any product marketed as "organic" / "biologisch" — certification by Skal Biocontrole, as well as any other local, national or European regulation specifically applicable to their own shop, activity, sector, product category, premises or legal form. Supervision and enforcement of these rules lie with the Netherlands Food and Consumer Product Safety Authority (NVWA).
Store owners further warrant that products presented as local, natural, pesticide-free, sustainable or non-processed are genuinely sourced from producers meeting those criteria, and that they are able to demonstrate provenance (city, province, country or European region of origin) on request. City Farm carries out no on-site inspection, sampling, audit or certification and assumes no responsibility for hygiene, contamination, mislabelling, fraudulent origin claims or regulatory breaches of any listed business.
Good faith and store-owner responsibility. City Farm publishes all information on the Platform in good faith, relying on what each store owner declares, and solely for the purpose of informing the consumer. Each store is fully and exclusively responsible for what it publishes on the Platform, including the accuracy, completeness, lawfulness, certification and updating of every listing, photograph, claim and price. By using City Farm the consumer expressly acknowledges that the Platform acts as a directory and guide, not as a seller, agent or guarantor, and that any complaint relating to a product, claim or service must be addressed directly to the store concerned.
3. No medical, nutritional or health advice
Content on the Platform is provided for general informational purposes only and does not constitute medical, nutritional, dietetic or health advice. Users with allergies, intolerances or specific medical conditions must verify product composition directly with the store before purchase.
4. User accounts and reviews
Users must provide accurate information and be at least 16 years old to create an account. Reviews must reflect a genuine first-hand experience. The following content is prohibited: defamation, hate speech, harassment, illegal content, advertising, spam, impersonation, infringement of intellectual property, and unsubstantiated accusations against stores or producers.
Reviews express the personal opinion of the user, not of City Farm. We may, but are not obliged to, moderate, edit or remove any user content at our sole discretion, and may suspend repeat offenders.
5. Store owner accounts
Store owners may subscribe to publish a listing. Subscription fees are displayed in-app. Listings remain visible only while the subscription is active. By publishing content the store owner warrants that they own or have all necessary rights to publish such content and that it complies with all applicable laws, including food safety, consumer protection, labelling, advertising, intellectual property and tax law.
6. Transactions, delivery and complaints
Any purchase, reservation, subscription or delivery agreed between a user and a store is a contract exclusively between those two parties. City Farm is not a party to that contract and bears no liability for product defects, late or non-delivery, refunds, exchanges, food poisoning, allergic reactions, contractual breaches or any other dispute.
Complaints concerning a store or its products must be addressed directly to that store.
7. Limitation of liability
The Platform is provided "as is" and "as available", without warranty of any kind, express or implied.
To the maximum extent permitted by Dutch law, City Farm, its operators, employees and partners shall not be liable for:
- any direct, indirect, incidental, special, consequential or punitive damages;
- loss of profit, revenue, data, goodwill or business opportunity;
- any product purchased from a listed store, including health consequences;
- inaccurate, outdated, incomplete or misleading information published by store owners;
- interruption, unavailability or errors of the Platform;
- actions or omissions of third parties, including stores, producers and other users.
Where liability cannot be excluded by law, it is limited to the amount actually paid by the user to City Farm in the twelve (12) months preceding the event giving rise to the claim, or to €50, whichever is lower.
8. Indemnity
Users and store owners agree to indemnify and hold City Farm harmless from any claim, demand, loss, damage, cost or expense (including reasonable legal fees) arising from their use of the Platform, their published content, their commercial activity, or their breach of these Terms or of any applicable law.
9. Intellectual property
The Platform, its design, code and original content are protected by intellectual property law. Content uploaded by store owners or users remains theirs, but they grant City Farm a worldwide, royalty-free, non-exclusive licence to host, display and promote such content on the Platform.
10. Privacy
Processing of personal data is described in our Privacy Policy, which forms part of these Terms.
11. Changes
We may update these Terms at any time. Material changes will be announced in-app. Continued use of the Platform after such changes constitutes acceptance.
12. Governing law and jurisdiction
These Terms are governed by the laws of the Netherlands. Any dispute shall be submitted to the competent courts of the Netherlands, without prejudice to mandatory consumer rights.
